這篇文章記錄了作者對台灣死刑制度實際運作過程的觀察。從具體發生的案例，我們可以看到死刑案件中的被告並未獲得公平審判的保障。例如，被告律師在申請閱卷時困難重重；就審判中的疑點或違法事由提出的再審或非常上訴聲請，無法得到檢察機關認真公平地審視；而缺乏明確證據就作成死刑判決的案例，更是層出不窮。

Will Taiwan Really Abolish the Death Penalty?

Abstract：
This note is an observation of the practice of the death penalty in Taiwan. Many cases show that death row inmates are not protected well by the principle of fair trial. For example, the defense attorneys are confronted by many difficulties from the government when they apply to examine and copy the case files, the applications of retrial or extraordinary appeal are not reviewed fairly by the prosecution, and sentencing to death by judges without concrete evidence.
